Release and Waiver of Liability 2026
PLEASE READ CAREFULLY! THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS.
This Release and Waiver of Liability (the “Release”) is executed on the date written below by the undersigned individual
(the “Volunteer”) in favor of Habitat for Humanity International, Inc., a nonprofit corporation, and Lake-McHenry Habitat for
Humanity, an Illinois nonprofit corporation, their directors, officers, employees, and agents (collectively, "Habitat").
The Volunteer desires to work as a volunteer for Habitat and engage in activities related to being a volunteer (the "Activities").
The Volunteer understands that the Activities may include constructing and rehabilitating residential buildings, working in
Habitat offices, and living in housing provided for volunteers of Habitat. The Activities may include, but are not limited to,
the use of tools and equipment, working at heights, exposure to dust, mold and other potentially hazardous substances,
and transportation.
The Volunteer does hereby freely, voluntarily, and without duress execute this Release under the following terms:
Release and Waiver. The Volunteer does hereby release, forever discharge, and hold harmless Habitat and its directors,
officers, employees, successors and assigns from any and all liability, claims, and demands of whatever kind or nature,
either in law or in equity, which arise or may hereafter arise from the Volunteer’s Activities with Habitat.
The Volunteer understands that this Release discharges Habitat from any liability or claim that the Volunteer may have
against Habitat with respect to bodily injury, personal injury, illness, death, or property damage that may result from the
Volunteer’s Activities with Habitat, whether caused by the negligence of Habitat or its officers, directors, employees, or
agents or otherwise. The Volunteer also understands that Habitat does not assume any responsibility for or obligation to
provide financial assistance or other assistance, including but not limited to medical, health, or disability insurance, in the
event of injury or illness.
Indemnification. The Volunteer agrees to indemnify and hold harmless Habitat and its directors, officers, employees,
successors and assigns from any and all liability, claims, loss or damage, whether in law or in equity, they may suffer or
caused to a third-party as a result of the Volunteer’s acts and/or omissions while participating in the Activities with Habitat.
The indemnity agreement contained in this paragraph shall survive the termination of this Release.
Medical Treatment. The Volunteer does hereby release and forever discharge Habitat from any claim whatsoever that
arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with the Volunteer’s
Activities with Habitat or with the decision by any representative or agent of Habitat to seek medical or dental treatment on
the Volunteer’s behalf in the event of an emergency.
Assumption of the Risk. The Volunteer understands that the Activities may include work that is hazardous to the Volunteer,
including, but not limited to, construction, loading and unloading materials, and transportation to and from work sites. The
Volunteer hereby expressly and specifically assumes the risk of injury or harm in the Activities and releases Habitat from all
liability for injury, illness, death, or property damage resulting from the Activities.
Insurance. The Volunteer understands that they are not an employee of Habitat and that except as otherwise agreed to by
Habitat in writing, Habitat does not carry or maintain any type of insurance coverage for any Volunteer, including but not
limited to health, medical, disability, liability, or workers’ compensation insurance. The Volunteer understands that if they
use their own vehicle while participating in any Activities with Habitat, that Habitat does not provide auto insurance coverage
of any type and that the Volunteer is responsible for providing their own auto insurance coverage.
Each Volunteer is expected and encouraged to obtain his or her own medical/health and auto insurance coverage.
Photographic Release. The Volunteer does hereby grant and convey unto Habitat all rights, title, and interest in any and
all photographic images and video or audio recordings made by Habitat during the Volunteer’s Activities with Habitat,
including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.
Other. The Volunteer expressly agrees that this Release is intended to be as broad and inclusive as permitted by the
laws of the State of Illinois, and that this Release shall be governed by and interpreted in accordance with the laws of the
State of Illinois. The Volunteer agrees that in the event any clause or provision of this Release is held to be invalid by any
court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions
of this Release, which shall continue to be enforceable.
